BHA to lose Withdean Planning Permission as well?

John Catt lives at an address overlooking the Athletics track that currently houses Brighton & Hove Albion Football Club. Mr Catt moved to the area after The Albion had already been playing there.

He successfully challenged the planning permission in the High Court a year ago through a legal technicality. At that time Brighton and Hove City Council, the owners of Withdean Stadium, admitted failing in its duty to carry out an environmental impact assessment or publish its reasons for granting consent.

The club re-applied and the application was passed last July. Mr Catt is now claiming the council still failed in its obligations under European law to consider the environmental impact. He is complaining of noise, disturbance, traffic and light pollution and claims that the planning consent is therefore unlawful.

He claims that he suffers enormous noise nuisance on match days, despite having told The Argus that he suffers from partial hearing. The Council have carried out noise surveys on match days and found that there is no noise nuisance.

Mr Catts legal challenges are funded by Legal Aid.

Albion chief executive Martin Perry said in the Argus: "Mr Catt is having another go. It shows how unrealistic it is when Lewes District Council and other Falmer opponents say we should just stay here long-term and enlarge the stadium.
